Esta coletânea é uma homenagem aos 70 anos do professor Emmanuel Carneiro Leão. Reúne artigos de seus alunos, amigos e admiradores que foram atraídos pela abrangência e rigor de seu pensamento. A diversidade de temáticas, abordagens e premissas destes ensaios refletem bem a generosidade do espírito de Emmanuel Carneiro.

No Brasil, tem-se a regulação e limitação da livre iniciativa em diversos campos. Nesse contexto, o presente trabalho visa discutir a (des)necessidade de regulação econômica no setor de transporte privado, tendo por pano de fundo o caso específico da empresa UBER. Para tanto, a metodologia utilizada tem caráter bibliográfico e qualitativo, com o objetivo de investigar quais as justificativas que têm sido apresentadas pelos que entendem como necessária a existência de regulação no setor. Do estudo concluiu-se que a conquista da (...) iniciativa privada pela regulamentação de empresa de transporte ‘público’ individual, tradicionalmente representativa de um serviço de concessão do Estado, representou uma grande evolução para o país. Emmanuel Levinas is one of the most important figures of twentieth-century philosophy. Exerting a profound influence upon such thinkers as Derrida, Lyotard, Blanchot, and Irigaray, Levinas's work bridges several major gaps in the evolution of continental philosophy--between modern and postmodern, phenomenology and poststructuralism, ethics and ontology. Ética e subjetividade no Budismo chinês contemporâneo Resumo: O presente artigo procura pensar as questões da ética e da subjetividade no contexto do pensamento budista na China contemporânea. Ele parte de uma genealogia do conceito de subjetividade conforme desenvolvido através do debate entre a escola Yogacãra do Budismo indiano e o Novo Confucionismo. AS NOVAS PERSPECTIVAS DO PROCESSO PENAL BRASILEIRO.

A POSTURA FILOSÓFICA DO INTÉRPRETE DO DIREITO, A SÍNDROME DE ABDULA E A NECESSÁRIA CONSTRUÇÃO DE UMA AUTONOMIA PEDAGÓGICO-UNIVERSITÁRIA.

Internationally renowned as one of the great French philosophers of the twentieth century, the late Emmanuel Levinas remains a pivotal figure across the humanistic disciplines for his insistence--against the grain of Western philosophical tradition--on the primacy of ethics in philosophical investigation. This first English translation of a series of twelve essays known as _Alterity and Transcendence_ offers a unique glimpse of Levinas defining his own place in the history of philosophy. Published by a mature thinker between 1967 and 1989, (...) these works exhibit a refreshingly accessible perspective that seasoned admirers and newcomers will appreciate. In today's world, where religious conceptions of exalted higher powers are constantly called into question by theoretical investigation and by the powerful influence of science and technology on our understanding of the universe, has the notion of transcendence been stripped of its significance? In Levinas's incisive model, transcendence is indeed alive--not in any notion of our relationship to a mysterious, sacred realm but in the idea of our worldly, subjective relationships to others. Without presupposing an intimate knowledge of the history of philosophy, Levinas explores the ways in which Plotinus, Descartes, Husserl, and Heidegger have encountered the question of transcendence. In discourses on the concepts of totality and infinity, he locates his own thinking in the context of pre-Socratic philosophers, Aristotle, Leibniz, Spinoza, Kant, and Descartes. Always centering his discussions on the idea of interpersonal relations as the basis of transcendence, Levinas reflects on the rights of individuals (and how they are inextricably linked to those of others), the concept of peace, and the dialogic nature of philosophy. One of the most influential philosophers of our day has selected 16 previously uncollected pieces that are unified by Levinas's project of revising the phenomenological description of the world in light of our experience of other persons.

This article brings a historical perspective to explain the recent dissemination of randomized controlled trials (RCTs) as the new “gold standard” method to assess international development projects. Although the buzz around RCT evaluations dates from the 2000s, we show that what we are witnessing now is a second wave of RCTs, while a first wave began in the 1960s and ended by the early 1980s. Drawing on content analysis of 123 RCTs, participant observation, and secondary sources, we compare the two (...) waves in terms of the participants in the network of expertise required to carry out field experiments and the characteristics of the projects evaluated. The comparison demonstrates that researchers in the second wave were better positioned to navigate the political difficulties caused by randomization. We explain the differences in the expertise network and in the type of projects as the result of concurrent transformations in the fields of development aid and the economics profession. We draw on Andrew Abbott’s concept of “hinges,” as well as on Bourdieu’s concept of “homology” between fields, to argue that the similar positions and parallel struggles conducted by two groups of actors in the two fields served as the basis for a cross-field alliance, in which RCTs could function as a “hinge” linking together the two fields. In several studies on the interpretation of the term politeuma, Patrick Sänger argues that it has three basic meanings: ‘political act’, ‘citizenry’ or ‘active citizenry’, and ‘polity’ and thus ‘state’, sometimes having the connotation ‘constitution’. Although the interpretation of the word can be traced back at least to Aristotle, it is generally acknowledged that its basic meanings can be found as well in Hellenistic and Roman literature, sometimes even used side by side. Taking into account the epoch in which Plutarch (...) wrote his work and the wide chronological period that it covers, it can be expected that Plutarch might be a very illustrative guide for the use of the term politeuma. The word occurs in fact 75 times throughout his work. In most cases, it is used only once or twice in a single biography or in a piece of the Moralia. There are, however, three exceptions to this global pattern: the Lives of Lycurgus and Numa, which concentrate 12 occurrences; those of Agis/Cleomenes and Tiberius/Gaius Gracchus with 13; finally, and from the Moralia, the An seni respublica gerenda sit, with 5 passages. This paper discusses the way Plutarch combines text and context, namely the way the concept of politeuma works in the context in which it is used throughout the Lives and the Moralia. En varios estudios sobre la interpretación del término politeuma, Patrick Sänger sostiene que tiene tres significados básicos: a) “acto político”, b) “la ciudadanía” o conjunto de ciudadanos activos”, y c) “sistema de gobierno” y, por lo tanto, “estado”, muchas veces con la connotación de “constitución”. Aunque la interpretación de la palabra suele remontarse hasta Aristóteles, generalmente, se reconoce que sus significados básicos pueden hallarse también en las Literaturas Helenística y Romana, a veces, incluso utilizados uno junto a otro. Teniendo en cuenta la época en la que Plutarco escribió su obra y el vasto período de tiempo que abarca, podemos considerarlo una guía muy ilustrativa sobre el uso del término politeuma. La palabra se registra 75 veces a lo largo de su obra. En la mayoría de los casos se la utiliza sólo una o dos veces en alguna biografía individual dentro de Moralia. Sin embargo, hay tres excepciones a este patrón general: las Vitae de Licurgo y Numa, incluyendo la Comparatio, que concentran 12 ocurrencias, aquellas de Agis/Cleomenes y Tiberio/Cayo Graco con 13 y, finalmente, en An seni respublica gerenda sit dentro de Moralia, en 5 pasajes. La philosophie, et en particulier la phénoménologie, se trouve aujourd'hui en France dans une situation pour le moins paradoxale dans son vis-à-vis avec la théologie. Alors que les uns e - accusent les phénoménologues d'un prétendu tournant théologique et que les autres s'en défendent comme si toute théologisation devait entacher leur intégrité, nul ne tente délibérément la traversée en prenant en charge les deux disciplines comme telles. En osant " passer le Rubicon " avec cette conviction que " plus on (...) théologise, mieux on philosophe ", cet ouvrage tente donc de mettre fin à la trop fréquente position de " chiens de faïence " et propose un " choc en retour " de la théologie sur la phénoménologie. Loin des philosophies du " seuil " ou du " saut ", une véritable rencontre des disciplines est ici revendiquée, dans l'assurance qu'elles seront mieux distinguées si elles acceptent d'être davantage assumées. Alea jacta est : " le sort en est jeté ", avec audace et peut-être témérité mais en sachant que nul ne pense s'il ne vient à s'exposer. (shrink)

La question de Dieu dans la pensée de Husserl fut très tôt un objet d'attention pour la recherche phénoménologique, mais la diversité des textes est telle qu'il était nécessaire d'établir le dossier historique relatif à cette question. Bien évidemment, la mise en lumière de l'unité et de la continuité des analyses de Husserl sur Dieu est animée par une interrogation proprement spéculative : quelle place pour Dieu dans une philosophie descriptive qui se veut méthodologiquement athée? A partir du "je" transcendantal, (...) quel est l'accès possible à la pure phénoménalité de Dieu? Si Husserl décrit la transcendance de Dieu comme celle d'une Idée théorique, éthique et téléologique, il ne s'agit pas pour lui de s'en tenir aux reconstructions abstraites de la métaphysique, niais de revenir à l'expérience originaire de Dieu. La réduction phénoménologique ne demande pas de cesser de croire, mais elle rend possible une purification éthique de l'expérience religieuse qui permet d'élucider son sens. En cela, tout le projet contemporain d'un concept non ontologique de Dieu est redevable à Husserl d'avoir fait le premier pas décisif en affranchissant de tout en soi " et en montrant que la transcendance de Dieu ne peut être séparée de la vie intentionnelle dans laquelle elle s'annonce. Husserl ne confond pas pour autant philosophie et théologie, et la compréhension de Dieu comme évidence d'une Idée pratique infinie laisse ouverte la possibilité de la Révélation sans vouloir parler pour elle. Nous nous sommes proposés d’étudier, dans ce travail, les conceptions et les expériences vécues dans des relations amoureuses d’adolescents appartenant aux couches dites « populaires » de la ville de Rio de Janeiro.Au moyen d’entretiens semi-structurés, nous avons interrogé dix adolescents, cinq du sexe féminin et cinq du sexe masculin, âgés de 13 à 17 ans, sur le rôle que ces relations tiennent dans leur vie. Nous pouvons en conclure que nos sujets ne semblent rien désirer de bien différent de (...) ce à quoi aspiraient les générations antérieures, car leurs paramètres et leurs aspirations sont demeurés pour la plupart les mêmes, si ce n’est qu’ils utilisent des moyens nouveaux et encore tout récents. La réflexion sur le positivisme juridique est au cœur d'interrogations importantes concernant la portée des règles de droit, la nature de l'Etat et les relations entre droit et morale. L'examen des présupposés et des thèses philosophiques de la Théorie pure du droit de Hans Kelsen et du Concept de droit d'Herbert Hart permet de s'orienter dans ces débats. Les deux auteurs proposent des théories distinctes d'une même réalité : la mise en vigueur, dans des collectivités, de règles possédant une forme (...) d'objectivité. Leurs descriptions du fonctionnement des systèmes juridiques obligent à reconduire à ses fondements l'examen de la nature et de la connaissance des normes. De ce fait, la comparaison des doctrines doit permettre de mieux comprendre, en particulier, l'articulation entre le registre du devoir-être et la prise en compte de la réalité de la vie sociale organisée par le droit. La philosophie de la nature de l'Encyclopedie des sciences philosophiques fut, jusqu'a une date recente, presque ignoree par les etudes hegeliennes. Hegel s'y serait rendu coupable d'une pretention a concurrencer les sciences positives sur leur propre terrain et a rivaliser avec elles, en revelant a la fois son incomprehension de la scientificite la mieux etablie et la faible rationalite de son propre projet. Une lecture attentive permet de rectifier ces prejuges, en montrant non seulement que Hegel s'y trouve attentif et (...) respectueux du savoir positif de son temps, mais encore qu'il tente d'y definir les modalites d'une collaboration methodologiquement reglee entre philosophie et sciences. En quoi consiste le projet d'une science speculative? En quoi consiste chez Hegel la deduction speculative de la verite? En quoi consiste la comprehension hegelienne du statut et des formes du discours des sciences de la nature? Quelle attitude la speculation doit-elle adopter face aux controverses scientifiques? L’esprit contemporain nous vole nos intériorités. Il entend façonner nos goûts et nos imaginaires. Orienter nos expériences. Nous détourner de nous-mêmes dans un divertissement généralisé, une mise en réseau et un art consommé de l’inquiétude qui est une autre manière de nous emporter dans son flux. C’est un homme mutilé, abruti, amoindri spirituellement que produit ce monde dominé par la technique qui ose appeler progrès les0régressions qu’il programme. L’art – entendu non comme savoir ou culture mais comme passion de la (...) liberté et exploration de nos sources enfouies – est l’un des derniers moyens qui nous restent pour nous savoir humains. Tout art digne de ce nom est insurrection, quête d’absolu, tentative désespérée pour dire l’amour incommensurable qui nous taraude. Emmanuel Godo, ici, nous provoque et nous convoque. Et si nous faisions l’épreuve de notre humanité – pour en avoir la preuve – en nous confrontant à des oeuvres d’art? Mais pas à des simulacres sans épaisseur ou à des joujoux insipides, non! La théorie critique de la société, telle qu'elle s'est développée dans le cadre de ce qu'on appelle parfois l'école de Francfort, se caractérise notamment par le fait qu'elle donne toute son importance aux dominations et aux conflits dans son analyse du monde contemporain. L'une de ses figures aujourd'hui centrales, Axel Honneth, est aussi l'auteur de la théorie de la reconnaissance sans doute la plus systématique et riche en perspectives théoriques et critiques. C'est de cette théorie qu'Emmanuel Renault part dans (...) cc livre, tout en lui apportant des inflexions justifiées d'une part par l'histoire de la théorie critique, d'autre part par l'analyse du temps présent. L'analyse de l'imbrication de la reconnaissance, de la domination et du conflit demande une approche spécifique : l'apport du pragmatisme américain et les débats sociologiques contemporains, en particulier Dewey et Bourdieu, complètent ici le modèle hégélien et les intuitions de Marx. Quelques exemples choisis parmi des objets souvent délaissés par les sciences sociales la conduite oppositionnelle d'un groupe de punks squatters, le langage protestataire de jeunes de banlieues populaires mettent à l'épreuve la capacité d'analyse de l'approche proposée par l'auteur, celle d'une philosophie sociale conçue comme une hybridation de la philosophie et des sciences sociales. Pretende-se demonstrar que a Educação Moral, defendida por Eric Weil, é um caminho privilegiado, sine qua non, que auxilia o ser humano no enfrentamento da violência. Evidencia que o educador toma lugar de destaque nessa discussão, pois lhe cabe a responsabilidade de indicar os meios e os caminhos para a universalização, para que a não violência possa subsidiar (...) uma cultura de paz entre os seres humanos. Para tanto, percorre o caminho metodológico fazendo uma abordagem na ampla teoria filosófica de Eric Weil, em especial, nas obras: Lógica da filosofia e Filosofia política, a fim de analisar os pontos mais relevantes para ancorar a concepção de imprescindibilidade da Educação e, também, por sua vez, do educador. Esta pesquisa será eminentemente lastreada por levantamentos bibliográficos nas obras do próprio Eric Weil, bem como nos comentários de alguns de seus comentadores. (shrink)

Given that Enlightenment rationality developed in Europe as European nations aggressively claimed other parts of the world for their own enrichment, scholars have made rationality the subject of postcolonial critique, questioning its universality and objectivity. In _On Reason_, the late philosopher Emmanuel Chukwudi Eze demonstrates that rationality, and by extension philosophy, need not be renounced as manifestations or tools of Western imperialism. Examining reason in connection to the politics of difference—the cluster of issues known variously as cultural diversity, political (...) correctness, the culture wars, and identity politics—Eze expounds a rigorous argument that reason is produced through and because of difference. In so doing, he preserves reason as a human property while at the same time showing that it cannot be thought outside the realities of cultural diversity. Advocating rationality in a multicultural world, he proposes new ways of affirming both identity and difference. Eze draws on an extraordinary command of Western philosophical thought and a deep knowledge of African philosophy and cultural traditions. He explores models of rationality in the thought of philosophers from Aristotle, René Descartes, Francis Bacon, and Thomas Hobbes to Noam Chomsky, Richard Rorty, Hilary Putnam, and Jacques Derrida, and he considers portrayals of reason in the work of the African thinkers and novelists Chinua Achebe, Ngugi wa Thiong’o, and Wole Soyinka. Eze reflects on contemporary thought about genetics, race, and postcolonial historiography as well as on the interplay between reason and unreason in the hearings of South Africa’s Truth and Reconciliation Commission. He contends that while rationality may have a foundational formality, any understanding of its foundation and form is dynamic, always based in historical and cultural circumstances. (shrink)

In this article we refine the design ofcontext shifting experiments, which play a central role in contextualist debates, and we subject a large number of scenarios involving different types of expressions of interest to contextualists, including ‘know’ and color adjectives like ‘green’, to experimental investigation. Our experiment (i) reveals an effect of changing contexts on the evaluation of uses of the sentences that we examine, thereby overturning the absence of results reported in previous experimental studies (so‐callednull results), (ii) uncovers evidence (...) for a ‘truth bias' in favor of positive over negative sentences, and (iii) reveals previously unnoticed distinctions between the strength of the contextual effects displayed by scenarios involving knowledge ascriptions and scenarios concerning color and other miscellaneous scenarios.
